Last week, U.S. District Judge Dabney Friedrich for the District of Columbia vacated the Centers for Disease Control and Prevention (CDC) eviction moratorium nationwide in Alabama Association of Realtors v. U.S. Department of Health and Human Services. The judge ruled that the CDC did not have the legal authority from the Public Health Service Act to impose a nationwide eviction moratorium. The U.S. Department of Justice appealed the decision and Judge Friedrich granted the defendants a temporary stay through May 12 until the DC Circuit Court of Appeals can weigh in.
