NH&RA signed a letter led by the National Leased Housing Association on the Federal Housing Administration’s (FHA) Advanced Notice of Proposed Rulemaking on Section 8 Project-Based Rental Assistance: Standard Program Regulation and Renewal Contract. HUD is proposing to transition to a single Section 8 regulation and a single Housing Assistance Payment (HAP) contract for its Section 8 project-based rental assistance programs. The proposal would lead to the loss of thousands of low-income units by creating an incentive for owners to opt out of the program, which is both inconsistent with the Administration’s focus on increasing the supply of affordable housing and the law governing HAP renewals, the Multifamily Assisted Housing Reform and Affordability Act (MAHRA).
