A Dec. 23 ruling by a U.S. District Court means the determination of fair market rent (FMR) in two dozen of the nation’s largest metropolitan areas has come full circle. HUD decided in August of 2017 to suspend implementation of Small Area Fair Market Rents – meaning PHAs in 23 metropolitan areas would have two additional years before implementing the regulation. In October, several fair housing groups filed suit challenging HUD’s suspension. The recent court ruling, however, has changed all of that, setting implementation back to its original date of January 1, 2018.
