HUD recently issued PIH Notice 2024-01 providing guidance to PHAs regarding the Buy America Preference (BAP) requirement of the Build America, Buy America Act (BABA). The notice establishes the timeline of the BAP application process and waivers to consider ahead of full BAP implementation over the next year. BABA requirements will apply to HUD awarded federal financial assistance at different points in time depending on the program and when waivers delaying or otherwise impacting implementation of the BAP for HUD programs expire. HUD further waived application of BABA restrictions for all HUD programs other than formula grants awarded pursuant to the CDBG through February 21, 2023.
