Last month, HUD issued an interim final rule eliminating the 30-day eviction notice requirement for nonpayment of rent for PHAs and multifamily owners, with an initial effective date of March 30.

After a lawsuit filed by the National Housing Law Project and others argued HUD should have allowed for public comment first, HUD announced it will treat the rule as a proposed rule instead.

  • The rule will not take effect until after comments are reviewed and a final rule is issued.
  • Comments are due April 27.
