The New Hampshire Housing rule prohibiting construction contracts between parties sharing an identity of interest may be waived by the Executive Director in their discretion pursuant to HFA 117.07(a)(1) A. viii). Waiver requests shall be submitted pursuant to HFA 117 (Waiver Rules) and the HFA 117 Waiver Requests Procedure Standards policy.

NH Housing now has underwriting policy guidance about the documentation needed to request a waiver. It also details what will be required if a waiver is granted. This is Attachment C to NH Housing’s Underwriting Standards and Development Policies for Multifamily Finance. This guidance is effective as of June 8, 2026.
