The Texas Department of Housing and Community Affairs (TDHCA) released the first draft of its 2012 QAP as well as a draft of the 2012 Definitions and Amenities for Housing Program Activities. Significant changes include:

  • Application extension requests must now be received 30 days prior to the application deadline
  • If two or more practical and feasible applications receive the same number of points, TDHCA will now determine a tie breaker based on the lowest number of units subject to a LURA by the Department, within three linear miles of the boundary of the proposed project
  • The Administrative Deficiency process will now allow applications to receive requested points based on TDHCA staff recommendation provided the information submitted in response to the Administrative Deficiency is received within 5 days of request of the missing information
  • Applicants are no longer required to submit an Experience Certification but someone with a controlling interest in the project must be able to demonstrate they have significant recent experience in housing tax credit development activities in Texas
  • Applicants are eligible to receive a 30% increase in Eligible Basis if the project qualifies for and receives Historic Tax Credits and the application reflects that the credits have been removed from Eligible Basis
  • Changing the market study submission date to March 1 (with the application) or adding additional points to incentivize the earlier submission of the market study to March 1
