The U.S. District Court for the District of Massachusetts issued a stay and preliminary injunction to prevent HUD from implementing its new Disparate Impact rule, which would make it harder to bring discrimination claims under the Fair Housing Act. Judge Mark Mastroianni’s preliminary injunction grants nationwide relief for the rule, which was set to take effect on October 26. The case was brought by Massachusetts Fair Housing Center and Housing Works – who were represented by Lawyers for Civil Rights. The suit claimed the new rule violates the Administrative Procedure Act (APA) and drew support and declarations from over a dozen community-based organizations.
