President Biden recently issued an Executive Order requiring that large-scale Federal construction projects with at least $35 million in costs use project labor agreements with one or more labor organizations. The order aims to promote structure, stability and efficiency in administering and completing Federal construction projects by reducing the likelihood of labor-related disruptions and lack of coordination among employers and workers. The Federal Acquisition Regulatory Council (FAR Council) is directed to promulgate regulations within 120 days and the effective date of the order will be the issuance of final regulations from the FAR Council. The order grants agencies the ability to issue exceptions.
