The Texas Department of Housing and Community Affairs (TDHCA) posted a revised summary of the 2021 Competitive nine percent LIHTC Award Limits and Estimated Regional Allocation, as well as a list of Applications that are eligible for an award of tax credits for the 2021 program year.

Texas Posts List of Properties Nearing End of Affordability

The Texas Department of Housing and Community Affairs (TDHCA) posted an interactive map and list of properties that may be nearing the end of their affordability period and may benefit from preservation activities. The list includes any federally subsidized multifamily housing development at risk because the contract granting a federal subsidy with a stipulation to maintain affordability is nearing expiration, or because the government-insured mortgage on the property is eligible for prepayment or near the end of its mortgage term. The current list reflects those properties that have an affordability period ending between March 2021 and December 2023.

Texas Posts 2021 Nine Percent Applicant List; NOFAs Account for Increased Construction Costs

The Texas Department of Housing and Community Affairs (TDHCA) posted a list of 2021 nine percent LIHTC Applications that are eligible for an award of tax credits for the 2021 program year. Developers with an appealable interest as a result of changes to the Application List posted on the TDHCA website, should submit a written appeal to the Department by close of business on June 30, 2021, to allow the matter to be considered by the executive director and potentially presented to the Governing Board at the meeting scheduled for July 8, 2021.

Texas Bill to Encourage LIHTC Developments Near Veterans Hospitals Goes to Governor

Texas legislation that would change the scoring system for allocating LIHTCs to encourage the development of affordable housing near veteran’s hospitals passed both houses of the Legislature and is on the desk of Governor Greg Abbott (R).

The Texas Department of Housing and Community Affairs suspended the deadline for 2021 nine percent LIHTC applicants to submit the Appraisal Review Fee.

HUD Updates FMRs for Areas in Maine and Texas

HUD updated the fair market rents (FMRs) for the Housing Choice Voucher Program, Moderate Rehabilitation Single Room Occupancy Program and other programs for Fiscal Year 2021 for four areas based on new survey data: Houston-The Woodlands-Sugar Land, TX HUD Metro FMR Area (HMFA), Knox County, ME, Lincoln County, ME and Waldo County, ME. Further, HUD responds to comments received on the FY 2021 FMRs.

District Judge Rules CDC Eviction Moratorium Unconstitutional, DOJ Appeals

On February 25, 2021, U.S. District Judge J. Campbell Barker issued a ruling in Terkel v. Centers for Disease Control & Prevention (CDC) that declares the CDC eviction moratorium unconstitutional.
